These Terms of Use (“Terms”) govern your access to and use of the website amplifymusicstudio.com (the “Site”) and related online services (collectively, the “Services”) provided by Amplify Music Studio (“Amplify Music Studio,” “we,” “our,” or “us”).

By accessing or using the Site or Services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or Services.

Amplify Music Studio is operated by Fitness Providers LLC (Voice 360) from Palm Beach County, Florida, USA.

1. Eligibility & Use of the Site

The Site is intended for parents or guardians of minor students, adult students, and individuals interested in private online music lessons, including piano, guitar, voice, ukulele, bass, music theory, songwriting, ear training, improvisation, composition, performance confidence, and homeschool enrichment.

You must be at least 18 years old to submit a lesson request, book a lesson, register an account, or enter into any payment agreement.

If you are a parent or legal guardian using the Site on behalf of a minor, you agree that you are responsible for the minor student’s use of the Services and for any information you provide about them.

2. Description of Services

Amplify Music Studio provides private online music instruction and coaching, which may include:

  • Piano lessons
  • Guitar lessons
  • Voice lessons and singing lessons
  • Ukulele lessons
  • Bass lessons
  • Music theory, ear training, note reading, rhythm, and musicianship support
  • Songwriting, composition, arranging, and creative music projects when applicable
  • Improvisation, performance coaching, and confidence-building support
  • Homeschool enrichment and music elective support
  • Practice support, skill-building, and student progress guidance
  • Information and resources about lessons, scheduling, pricing, policies, and education funding options
  • A Student Portal or scheduling system through third-party studio management software, such as My Music Staff, where families may view scheduling, lesson information, billing, and account details

We may update, modify, or discontinue any part of the Site or Services at any time, with or without notice.

3. No Guarantee of Results

We work hard to provide high-quality instruction and support. However:

  • We do not guarantee specific results or outcomes, such as audition results, performance opportunities, school placement, competition results, mastery of a particular piece, or a specific level of improvement.
  • Student progress depends on many factors, including practice, consistency, age, readiness, prior experience, instrument access, and individual learning needs.
  • By using the Services, you acknowledge that results will vary from student to student.

4. Lesson Scheduling, Cancellations & Payments

Lesson scheduling, cancellation policies, payment details, and studio guidelines may be described in more detail on the Site, in booking materials, in the Student Portal, or in other studio communications. In general:

  • Lessons may be booked as weekly lessons or drop-in lessons, depending on availability and current studio offerings.
  • Lessons may be offered in 30-minute or 60-minute formats, or in other formats as posted on the Site.
  • Cancellation and rescheduling require advance notice within the timeframe stated on the Site, in booking materials, or in studio policies. Late cancellations and no-shows may be charged as completed lessons.
  • If make-up credits are issued for an approved missed lesson, they must be used within the timeframe communicated by the studio or they may expire.
  • Payments are generally handled in advance through the Student Portal, approved third-party payment systems, or approved ESA/school-choice platforms when applicable.
  • By scheduling and paying for lessons, you agree to follow the current studio policies in effect at the time of your registration and any updates we reasonably communicate.
  • We reserve the right to update lesson policies, lesson availability, rates, payment methods, and studio guidelines from time to time.

5. Education Savings Accounts (ESA) & School-Choice Programs

For families using an Education Savings Account (ESA), scholarship, or similar school-choice funding program:

  • You are responsible for ensuring that our Services are eligible under your specific program and for completing any required applications, approvals, reimbursements, purchase orders, or forms.
  • We may assist by providing documentation, such as invoices, service descriptions, lesson details, or other information reasonably needed for your ESA or school-choice program.
  • We do not control the approval, timing, processing, or release of funds by any ESA provider, scholarship organization, state agency, marketplace, reimbursement platform, or school-choice authority.
  • Lessons may be scheduled, continued, or paused based on whether sufficient funds have been approved, received, or applied to your account, in accordance with studio policies.
  • We are not liable for decisions, delays, denials, platform errors, reimbursement issues, or funding interruptions caused by ESA providers, school-choice programs, state agencies, or other third-party funding platforms.
  • For prepaid lesson packages funded through an ESA or school-choice program, unused lessons are non-refundable except where required by the applicable ESA program or by law. If a refund is permitted or required, any refunded amount will be returned only to the student’s ESA account through the applicable platform. No refunds will be issued to a parent, guardian, or personal payment method unless expressly required by law or program rules.
  • If these Terms or studio policies conflict with the applicable ESA or school-choice program’s rules, the program’s rules control for ESA-funded transactions.

6. Online Lessons & Technology

Online lessons may take place through video platforms such as Google Meet, Zoom, FaceTime, or another approved platform.

Students and families are responsible for having a reliable internet connection, appropriate device, working camera and audio, and any materials needed for the lesson, such as an instrument, sheet music, method book, lyrics, accompaniment tracks, notes, worksheets, or assigned practice materials.

We are not responsible for interruptions caused by internet outages, device problems, software issues, platform downtime, or other technical issues outside of our control.

For minor students, a parent or guardian should be reasonably available during lessons and is responsible for ensuring the student participates in a safe and appropriate environment.

7. Intellectual Property

Unless otherwise stated, all content on the Site and in our online materials is owned by or licensed to Amplify Music Studio and is protected by copyright, trademark, and other intellectual property laws. This may include, but is not limited to:

  • Text, copy, and written materials
  • Logos, graphics, icons, and images
  • Videos, audio samples, and lesson resources, excluding student-submitted content
  • Worksheets, guides, PDFs, handouts, practice materials, exercises, charts, and studio materials
  • Layout, design, and overall look and feel of the Site

You may view the Site for your personal, non-commercial use and print or save limited copies of materials for your own lessons or your child’s lessons.

You may not reproduce, distribute, modify, sell, publicly display, publish, or share our content without prior written permission. You may not share paid lesson materials publicly or with anyone not enrolled in the studio. You may not use our trademarks, logos, or branding in a way that suggests endorsement, partnership, or affiliation without written permission.

8. User Conduct

When using the Site and Services, you agree not to:

  • Use the Site or Services for any unlawful purpose or in violation of applicable laws or regulations
  • Attempt to gain unauthorized access to any account, system, or network connected to the Site
  • Interfere with or disrupt the security, integrity, or performance of the Site
  • Submit false, misleading, defamatory, harassing, obscene, or inappropriate content
  • Abuse, harass, threaten, or use inappropriate language toward any teacher, student, parent, contractor, or staff member
  • Record, distribute, or post lesson content without permission

We reserve the right to suspend or terminate access to the Services for any user who violates these Terms, fails to follow studio policies, or engages in behavior that jeopardizes the safety, privacy, or well-being of others.

9. Third-Party Services & Links

The Site may link to or integrate with third-party services, including but not limited to:

  • Studio management tools, such as My Music Staff
  • Video lesson platforms, such as Google Meet, Zoom, or FaceTime
  • Payment processors and ESA or school-choice platforms
  • Email marketing or communication tools
  • Social media platforms, directories, or external websites

We are not responsible for the content, policies, security, availability, or practices of third-party websites or services. Your use of those services is governed by their own terms and privacy policies.

10. Disclaimers

The Site and Services are provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Site will be uninterrupted, error-free, secure, or free from viruses or other harmful components. We do not guarantee any particular outcome from the use of the Services.

Your use of the Site and Services is at your own risk.

11. Limitation of Liability

To the fullest extent permitted by law:

  • Amplify Music Studio, Fitness Providers LLC (Voice 360), and their owners, directors, contractors, teachers, affiliates, and service providers shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to your use of, or inability to use, the Site or Services.
  • Our total liability to you for any claim arising out of or relating to the Site or Services shall not exceed the amount you paid to us for lessons or Services during the three months preceding the event giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you. In such cases, the limitations will apply to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Amplify Music Studio, Fitness Providers LLC (Voice 360), and their owners, contractors, teachers, affiliates, and service providers from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to:

  • Your use of the Site or Services
  • Your violation of these Terms
  • Your violation of studio policies
  • Your violation of any rights of another person or entity

13. Governing Law & Jurisdiction

These Terms and any disputes arising out of or related to them, the Site, or the Services shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.

You agree that any legal action or proceeding arising out of or related to these Terms, the Site, or the Services shall be brought exclusively in the state or federal courts located in Palm Beach County, Florida, and you consent to the personal jurisdiction of those courts.

14. Changes to These Terms

We may update or modify these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. We may also provide additional notice for material changes, such as posting a notice on the Site.

Your continued use of the Site or Services after any changes to these Terms constitutes your acceptance of the updated Terms. If you do not agree to the changes, you should stop using the Site and Services.
